Terms of sale
These terms of sale apply to the paid plans (Pro and Business) of the hosted service at app.silencewatch.com. They complete the terms of use, which govern the use of the service itself, and do not concern an instance you host yourself.
The seller is the publisher identified in the legal notice. You can reach them at contact@silencewatch.com.
1. The plans
Section titled “1. The plans”The plans, their limits (checks, projects, alert channels, retention) and their prices are those of the Pricing page at the time you subscribe. The free plan has no commitment and no payment. Every plan has the same features: only the limits change.
2. Prices and taxes
Section titled “2. Prices and taxes”Prices are in euros, per month. VAT not applicable, article 293 B of the French General Tax Code: the price shown is the price paid.
The publisher may change its prices. A new price applies to a running subscription only at its next renewal, after you have been told by email at least 30 days ahead; you may cancel before it applies.
3. Subscribing and paying
Section titled “3. Subscribing and paying”You subscribe from the application (Settings → Subscription). The card payment is processed by Stripe, which receives the payment data: the publisher neither sees nor stores your card number. The subscription starts when the first payment succeeds, and the plan applies immediately.
4. Term and renewal
Section titled “4. Term and renewal”The subscription is monthly and renews automatically every month, at the same price, until you cancel it. Each payment is taken on the anniversary of the subscription date. An invoice is sent to you with every payment.
If a payment fails, Stripe retries it for a few days. If it still cannot be collected, the subscription ends and the account returns to the free plan (see section 7).
5. Cancelling
Section titled “5. Cancelling”You can cancel at any time from the application (Settings → Subscription → Manage subscription), without notice or fee. The cancellation takes effect at the end of the period already paid, which you can use until then. The publisher may also cancel, in particular for a breach of the terms of use, by telling you; the paid part of the unused period is then refunded, unless the breach is serious.
6. Refunds
Section titled “6. Refunds”Any period that has begun is due. Apart from the cases below, there is no pro-rata refund for a cancellation in the middle of a period. If you were billed by mistake, or if the service was unavailable for a long time through the publisher’s fault, write to the address above: a refund is considered.
7. Changing plan and going back to the free plan
Section titled “7. Changing plan and going back to the free plan”You can change plan from the billing portal; Stripe works out the pro-rata. When a plan goes down or the subscription ends, the limits of the new plan apply: what exceeds them is not deleted but paused (checks) or purged after the new plan’s retention (history). Nothing is removed from your configuration without your action.
8. Professionals only
Section titled “8. Professionals only”The paid plans are intended for professionals, meaning people who subscribe for the needs of their business or professional activity. By subscribing you declare that this is the case, and the publisher may ask you to confirm it. The consumer-protection rules on distance selling (right of withdrawal) and on consumer mediation therefore do not apply to these plans. The free plan is open to everyone.
9. Governing law
Section titled “9. Governing law”These terms are governed by French law. In case of dispute, the courts of Toulouse have jurisdiction.
